Welcome to Lenda, a mobile-first web application designed to support informal money lenders, “Machonisas,” and Stokvel lending groups in South Africa. By creating an account or using Lenda, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using Lenda, you acknowledge that:

  • You have read and understood these Terms.
  • You agree to be bound by them.
  • If you are using Lenda on behalf of a group or organization, you have the authority to do so.

If you do not agree, you must not use the app.

2. Eligibility

You must:

  • Be at least 18 years old
  • Have the legal capacity to enter into agreements
  • Use Lenda for lawful, responsible lending activities

Lenda is not intended for children or minors.

3. Description of the Service

Lenda provides tools for:

  • Solo lending operations
  • Stokvel/Group lending
  • Capital tracking
  • Loan creation, repayments, and ledger management
  • Group governance (roles, permissions, approvals)
  • Borrower management
  • Financial reports and analytics
  • AI-powered chat assistance for insights, calculations, and guidance

Lenda does not provide loans, act as a financial institution, or guarantee repayment between users and their borrowers.

4. User Responsibilities

4.1 Use Lenda Lawfully

You are solely responsible for:

  • Ensuring your lending practices comply with the laws of South Africa
  • Understanding relevant regulations (e.g., National Credit Act, interest rate limits)
  • Following ethical and responsible collection behavior

Lenda provides informational compliance guidance but does not provide legal advice.

4.2 Accuracy of Information

You must ensure that:

  • Any borrowers, payments, loan terms, and financial entries you record are accurate
  • You have obtained consent from borrowers or members before storing their data

4.3 Account Security

You are responsible for:

  • Keeping your password secure
  • Monitoring access to your account
  • Notifying us immediately of unauthorized use

5. Group (Stokvel) Mode Responsibilities

If you start or join a group in Lenda, you agree to:

5.1 Role-Based Permissions

Admins, Treasurers, and other roles have varying access levels. Your group is responsible for:

  • Assigning roles
  • Managing permissions
  • Removing or updating members as needed

5.2 Group Data Visibility

Group members may access:

  • Contribution amounts
  • Loan applications
  • Payments
  • Decisions requiring approval
  • Group financial history

You agree not to misuse or disclose group data.

6. AI Assistant Usage

Lenda includes an AI-powered assistant that can:

  • Answer questions
  • Analyze your lending data
  • Generate reports
  • Provide general compliance guidance

You understand that:

  • AI outputs may not always be correct
  • Compliance answers are informational only
  • You are responsible for verifying legal or financial decisions

7. Prohibited Activities

You may not use Lenda to:

  • Engage in unlawful lending
  • Harass borrowers or members
  • Misrepresent financial records
  • Attempt to reverse-engineer or disrupt the platform
  • Upload harmful, abusive, or defamatory content
  • Violate applicable laws or regulations

We may suspend or terminate accounts for violations.

8. Data & Privacy

Your use of Lenda is also governed by our Privacy Policy, which explains:

  • What data we collect
  • How we use it
  • How we protect it

By using Lenda, you consent to the practices described in the Privacy Policy.

9. Subscription, Fees & Payments

(This section is a placeholder as Lenda is currently free.) If Lenda offers paid plans or subscription features, the following applies:

  • Fees will be clearly displayed before purchase.
  • Prices may change, and you will be notified.
  • Payments are non-refundable except where required by law.
  • Continued use of premium features requires an active subscription.

10. Availability & Maintenance

We aim for high uptime, but we do not guarantee:

  • Uninterrupted access
  • Error-free performance
  • Complete data accuracy at all times

We may temporarily suspend the service for maintenance, security upgrades, or technical issues.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Lenda is provided “as-is” without warranties of any kind.
  • We are not liable for financial losses, data loss, or misuse of the app.
  • We are not responsible for decisions made based on AI assistant outputs.

You use the app at your own risk. Lenda does not guarantee loan repayment, borrower behavior, or group member conduct.

12. Termination

We may suspend or terminate your access if you violate these Terms, misuse the platform, or engage in unlawful or unethical lending practices. You may delete your account at any time.

13. Changes to the Terms

We may update these Terms periodically. When we do, the “Last updated” date will change, and significant changes will be communicated within the app. Continued use of Lenda means you accept the updated Terms.
